Welcome to LABAU (“LABAU,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the LABAU mobile application, website, and services (collectively, the “Service”).
By creating an account, downloading the app, or using the Service in any capacity (as a Customer, Retail Partner, or Delivery Partner), you agree to be bound by these Terms.
If you do not agree, you may not use the Service.
1. DEFINITIONS
“Customer” – an individual using LABAU to shop in-store inventory and request delivery.
“Retail Partner” – a store or brand participating in the LABAU platform.
“Delivery Partner” – an independent contractor who picks up and delivers items on behalf of customers.
“Order” – any confirmed purchase placed through the LABAU app.
“Service” – the LABAU app, website, and all features including ordering, delivery, and returns.
2. ELIGIBILITY
You must be:
At least 18 years old
Able to enter into legally binding contracts
Using the Service for lawful purposes
Delivery Partners must meet all verification, onboarding, and identification requirements.
3. DESCRIPTION OF SERVICE
LABAU is a same-day fashion delivery platform that enables:
Customers to shop in-store inventory via the LABAU app
Delivery Partners to pick up and deliver items
Retail Partners to fulfill customer orders
LABAU does not manufacture, own, or sell the items listed on the platform. All products are sold directly by the Retail Partner.
LABAU provides:
Ordering
Delivery
Return options
Customer service
Payment processing
4. ACCOUNT CREATION & SECURITY
To use LABAU, users must create an account and provide accurate information.
You are responsible for:
Maintaining confidentiality of your login
All activity under your account
Notifying LABAU of unauthorized access
LABAU may suspend or terminate accounts for fraud, misuse, or violations of these terms.
5. CUSTOMER USE OF THE SERVICE
Customers agree to:
Provide accurate delivery information
Make themselves available for delivery
Inspect items upon arrival
Follow proper return procedures
Customers understand delivery times are estimates and may vary due to traffic, availability, or location.
6. RETAIL PARTNER TERMS
Retail Partners agree to:
Provide accurate inventory
Prepare orders promptly
Verify pickup with Delivery Partners
Follow LABAU’s packaging and handoff standards
Retail Partners are responsible for product quality and compliance with consumer laws.
LABAU does not guarantee minimum sales, volume, or placement.
7. DELIVERY PARTNER TERMS
Delivery Partners:
Are independent contractors, not employees
Control their own schedules and work methods
May use a vehicle, bike, public transit, or walk (in qualifying cities)
Must meet all delivery time windows
Must follow all safety, verification, and professionalism guidelines
Delivery Partners are paid per delivery. Tips belong 100% to the Delivery Partner.
Delivery Partners are responsible for:
Their own taxes
Their own expenses (gas, transit, etc.)
Having and maintaining insurance
Maintaining any required licenses or permits
8. PAYMENTS, FEES & TIPS
For Customers
Customers pay:
Item total
Delivery fee
Optional return protection
Applicable taxes
All payments are processed through secure third-party providers.
For Delivery Partners
Delivery payouts vary per order based on distance, demand, and tier level.
For Retail Partners
Retailers pay no fees to participate unless otherwise stated in a negotiated agreement.
9. RETURNS & REFUNDS
LABAU offers two return options:
1. Orders Placed Through LABAU
Returns submitted through the app may result in:
Store credit issued within 24–36 hours, depending on the retailer
Delivery Partner pickup and return (where available)
Shipping fees, service fees, and delivery fees are non-refundable.
2. Items Purchased Outside LABAU
Customers may request a return pickup.
LABAU will:
Pick up the item
Verify it
Return it to the store on the customer’s behalf
Refunds for outside purchases follow the store’s policies, not LABAU’s.
10. PROHIBITED USES
You may not:
Use LABAU for illegal activity
Commit fraud, abuse, or chargebacks
Interfere with deliveries
Harass, threaten, or harm any Delivery Partner, Customer, or Retail Partner
Attempt to reverse engineer or misuse the app
Violation may result in account suspension or legal action.
11. SERVICE MODIFICATIONS
LABAU may:
Modify or discontinue the Service
Update features
Adjust pricing
Change delivery options
with or without notice.
12. INTELLECTUAL PROPERTY
All LABAU trademarks, logos, designs, and content belong to LABAU Holdings LLC.
Users may not copy, reproduce, or distribute LABAU materials without permission.
13. DISCLAIMERS
LABAU is provided “as is” and without warranties of any kind.
We do not guarantee:
Product quality
Delivery times
Inventory accuracy
Availability of Delivery Partners
LABAU is not liable for delays, damages, loss, or theft caused by third parties.
14. LIMITATION OF LIABILITY
To the maximum extent allowed by law, LABAU is not responsible for:
Indirect, incidental, or consequential damages
Loss of profits
Service interruptions
Delays outside our control
Users agree LABAU’s total liability will not exceed the amount paid for the order.
15. INDEMNIFICATION
Users agree to indemnify and hold LABAU harmless from claims arising out of:
Misuse of the app
Violations of these terms
Interactions with other users
Incorrect information provided
16. GOVERNING LAW
These Terms are governed by the laws of Louisiana
Any disputes will be resolved in applicable state or federal courts.
17. CHANGES TO TERMS
LABAU may update these Terms at any time. Continued use of the Service constitutes acceptance of the revised Terms.
